                  1. Wykonawcom, a także innym podmiotom, jeżeli ich interes prawny w uzyskaniu zamówienia doznał lub może doznać uszczerbku w wyniku naruszenia przez Zamawiającego przepisów ustawy, przysługują środki ochrony prawnej opisane w Dziale VI ustawy.

                  2. Na podstawie art. 180 ust. 1 Wykonawcy przysługuje odwołanie wyłącznie od niezgodnej z przepisami ustawy czynności zamawiającego podjętej w postępowaniu o udzielenie zamówienia lub zaniechania czynności,do której zamawiający jest zobowiązany na podstawie ustawy.

                  3. Odwołanie wnosi się do Prezesa Krajowej Izby Odwoławczej w terminach określonych odpowiednio w art.182 ustawy. Odwołujący przesyła kopię odwołania Zamawiającemu przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.

                  4. Na orzeczenie Krajowej Izby Odwoławczej stronom oraz uczestnikom postępowania przysługuje skarga do sądu. Skargę wnosi się do sądu okręgowego właściwego dla siedziby Zamawiającego za pośrednictwem Prezesa Krajowej Izby Odwoławczej, w terminie 7 dni od dnia doręczenia orzeczenia, przesyłając jednocześnie jej odpis przeciwnikowi skargi.
